Terms and Conditions for Professionals

General terms and conditions of sale applicable to sales concluded on mydoors.fr with professional buyers holding a Mydoors Pro account.

Seller: Mydoors, HAUGHTON Julien, sole trader (micro-enterprise), 114 Rue d'Épinal 62620 MAISNIL-LES-RUITZ  SIRET 130473242 00019, contact@mydoors.fr, 0618340355. VAT not applicable, art. 293 B of the French General Tax Code.

Article 1 – Scope

These terms apply to sales concluded on mydoors.fr with professional buyers holding a Mydoors Pro account. They are accepted upon opening the account and override the buyer's purchasing terms, unless otherwise agreed in writing. Sales to consumers remain governed by the general public terms and conditions of sale.

Article 2 – Opening a Pro Account

Account opening is reserved for registered companies with an active SIRET number. Mydoors reviews each request and may refuse it without having to justify its decision. The buyer undertakes to keep their information up to date. The level (Pro or Pro Partner) depends on the purchase volume observed during a quarterly review.

Article 3 – Orders and Quotes

The order is placed online from the Pro account. The buyer can enter their purchase order number. A quote issued by Mydoors is valid for 15 days. The order becomes binding upon confirmation by email.

Article 4 – Prices

Prices are in euros, net of taxes, VAT not applicable (art. 293 B of the French General Tax Code). The applicable price is the one displayed in the Pro account at the time of the order, depending on the buyer's level. Delivery costs are indicated before validation. Professional discounts cannot be combined with public codes and promotions.

Article 5 – Payment

Payment is made by credit card at the time of the order, or by bank transfer within 7 days; in this case, the order is shipped upon receipt of the transfer. Pro Partner accounts may benefit from payment within 30 days of the invoice date, up to a credit limit of €1,500. No discount is granted for early payment.

Any late payment automatically, without prior reminder, incurs penalties at a rate of three times the legal interest rate, as well as a fixed indemnity for collection costs of €40 (art. L441-10 and D441-5 of the French Commercial Code). Mydoors may then suspend pending orders and revert to payment at the time of the order.

Article 6 – Year-End Rebate

A year-end rebate is granted in the form of a voucher, calculated on paid purchases for the calendar year: 2% above €5,000, 3% above €10,000. The voucher is issued in January and can be used for 6 months. It is non-refundable.

Article 7 – Delivery and Transport

Orders are shipped within 1 to 2 business days, which is an indicative timeframe. Risks are transferred to the buyer upon delivery of the products to the carrier. In the event of damage or missing items, the buyer must make precise reservations on the delivery note and confirm them to the carrier by registered letter within 3 days (art. L133-3 of the French Commercial Code), with a copy sent to Mydoors.

Article 8 – Retention of Title

Mydoors remains the owner of the products until full payment of the price. In the event of non-payment, Mydoors may take back the products that have not yet been installed.

Article 9 – Conformity and Returns

Apparent defects or reference errors must be reported by email within 8 days of receipt, with photos. As a commercial gesture, Mydoors accepts returns within 14 days of new, unassembled products in their original packaging, return costs borne by the buyer. Returns are excluded for: custom-made springs, shafts and joints cut to length, assembled or modified products.

Article 10 – Guarantees

Products benefit from the guarantee against hidden defects (art. 1641 et seq. of the French Civil Code). Motorized products also benefit from the manufacturer's guarantee (2 or 5 years depending on the model, indicated on the product sheet). Guarantees do not cover normal wear and tear, installation not compliant with the manufacturer's instructions and applicable standards, or modification of the product.

Article 11 – Liability

The buyer, a professional, is solely responsible for the choice of parts, their compatibility with the installation, and their installation. Except in cases of gross negligence or fraud, Mydoors' liability is limited to the amount of the order concerned and excludes indirect damages (loss of operating profit, construction site penalties).

Article 12 – Personal Data

The data of the buyer's contacts is processed for account management, orders, and the business relationship, and is kept for the duration of the relationship and then according to legal timeframes. Each contact may exercise their rights of access, rectification, objection, and erasure by contacting contact@mydoors.fr.

Article 13 – Intellectual Property

The texts, photos, and technical sheets on the site may not be reproduced without written agreement from Mydoors.

Article 14 – Applicable Law and Disputes

These terms are subject to French law. Failing an amicable agreement, any dispute between professionals shall be subject to the Arras Commercial Court.
